Decision

1This is a job competition grievance.

2On March 20, 2025 the parties attempted to mediate the grievance. The parties then engaged in case management and agreed to the following schedule:

Notice

April 4, 2025 – OPSEU will provide the successful applicant in the job competition, now the incumbent with notice of the proceedings scheduled for October 20, November 10 and December 1, 2025;

Prehearing Production & Particulars

April 25, 2025 - OPSEU will make any remaining prehearing production requests to the Employer;

May 23, 2025 – The Employer will provide prehearing production to OPSEU. If the Employer objects to producing a document it will set out the basis for the objection in writing;

June 20, 2025 OPSEU shall deliver to the Employer comprehensive particulars of the grievance;

Agreed Statement of Fact

August 8, 2025 – The Employer will deliver a draft ASF to OPSEU;

August 22, 2025– OPSEU will deliver its response to the draft ASF; and

September 12, 2025 – The parties will finalize the ASF, which will:

• Outline all agreed and/or undisputed facts;

• Include additional facts that any party seeks to rely on, specifying which party is relying on them; and

• Compile a set of associated documents.

3If necessary, any procedural issues will be addressed via a conference call.

4Continuation dates are scheduled for October 10, November 10, and December 1, 2025.

5All dates contained in this case management decision are subject to change on agreement of the parties or direction of the arbitrator.
