Decision
1I have three Union grievances before me which raised issues concerning paragraphs 7, 8 and 9 of a Memorandum of Settlement dated June 5, 2007 (the “2007 GUDA MOS”). In resolving all but one feature of the three Union Grievances, the parties requested the GSB to issue the following consent order:
In accordance with paragraph 8 of the 2007 GUDA MOS, the Employer ought to have met with the Joint Insurance Benefit Review Committee (“JIBRC”) to discuss in good faith potential options concerning the March 2023 three-month contribution holiday before the Employer made its determination.
In accordance with paragraph 9 of the 2007 GUDA MOS, the Employer ought to have provided the JIBRC with the semi-annual financial statements not later than 120 days following the reporting period in respect of several reporting periods in the past.
This Consent Order fully and finally resolves Grievances GSB No. 2021-3315, GSB No. 2021-3285 and GSB No. 2023-01672, save and except the outstanding issue between the Parties regarding paragraph 7 of the 2007 GUDA MOS of which Arbitrator Petryshen remains seized.
The Board hereby declares that this Consent Order is binding on the parties.
