Decision
1This matter proceeded on December 3, 2025, before the Board. The Parties engaged in mediation efforts but were not able to reach a settlement during the hearing date.
2Accordingly, August 20, 2026 and September 10, 2026 are set as continuation dates.
3The Parties will proceed utilizing “will say” statements for the chief of their witnesses, instead of hearing viva voce evidence. The will say statements may be supplemented with brief oral testimony.
4The Parties agreed to the following timetable for the exchange of documents, particulars and the will says:
By January 30, 2026, the Employer will provide production and advise AMAPCEO of any material it is refusing to produce;
By February 27, 2026, AMAPCEO is to produce the Complainant’s will say and any documents it intends to rely upon;
By May 1, 2026, the Employer is to produce the will says for its witnesses and any documents it intends to rely upon;
By June 1, 2026, AMAPCEO will provide any reply will say and documents;
5The Parties also agreed to prepare a joint document book. The Parties agreed this step will be completed once the will says and documents have been finalized.
6In the event that the Parties require my assistance, a conference call can be scheduled.
