HEARING
December 15, 2025
Decision
1This matter convened on December 15, 2025, with respect to two grievances filed by the Grievor.
2The first grievance (GSB #2024-01863), which alleged the Employer violated Articles 2, 3 and 9 of the Collective Agreement, was filed on May 21, 2024 ("Grievance 1"). The second grievance (GSB #2024-02496), which alleged the Employer violated Articles 2, 7 and 9 of the Collective Agreement, was filed on November 22, 2024 ("Grievance 2").
3The Grievor filed another grievance on August 1, 2025 (Union #2025-0506-0002), which alleged the Employer violated Articles 2, 3 and 9 of the Collective Agreement ("Grievance 3").
4The Union advised it was withdrawing Grievance 1 with prejudice.
5The Parties agreed to consolidate Grievances 2 and 3.
6After hearing the representations from the Parties, I have decided to issue a timeline with respect to next steps in this matter.
7The Union is to provide particulars and production with respect to Grievances 2 and 3 by January 9, 2026.
8The Employer is to provide production on Grievance 3 on or before January 30, 2026.
9The Employer advised it may raise a preliminary objection to Grievance 3, pending review of the particulars. The Employer is ordered to advise the Union if it is raising a preliminary objection, and the nature of any preliminary objection(s) it wishes to raise, on or before January 30, 2026.
10Both Parties expressed their desire to litigate these grievances efficiently. The Parties agreed to make best efforts to reach an Agreed Statement of Facts ("ASF") for Grievance 3. The Employer will provide a draft ASF for Grievance 3 to the Union on or before January 30, 2026.
11The Employer will provide production on Grievance 2 on or before February 9, 2026. It will also advise the Union if it has any preliminary objections it intends to bring on that grievance by the same date.
12The Parties are to finalize the ASF for Grievance 3 on or before February 17, 2026, in order to determine if any witness evidence is needed and the scope of this evidence.
13The Parties have agreed that hearing for Grievance 3 will be completed in one hearing date. This includes argument with respect to any preliminary objections raised, which will be argued at the same time as the case proceeds on its merits. This is also inclusive of any witness evidence required, which will be limited to the specific issue(s) in dispute.
14This matter will proceed, as scheduled, on February 24, 2026.
