Decision
1The two grievances before me involve claims of breaches of the Employer’s duty to accommodate the Grievor’s medical restrictions caused by disability.
2At a conference call held on May 30, 2025, the parties agreed that if, by June 30, 2025, the Union was not satisfied that the Employer had fulfilled the Union’s request for production of documents, the Union would request an order for production.
3On October 30, 2025 the Union advised the Board that it had not received production and sought an order. I issued an order for production of the requested documents by the Employer by the end of the day November 3^rd^, 2025.
4The Union seeks a further order for production and the Employer does not object to this order.
5I hereby direct as follows:
- The Employer is to produce to the Union the following not later than 5pm on November 21, 2025:
a. the Grievor’s entire personnel file; and,
b. all documents pertaining to the Grievor’s injury on May 9, 2023 and/or to the employer’s consideration of whether and how to accommodate the medical restrictions caused by that injury, including but not limited to emails, notes, minutes of meetings.
- The deadline specified in this order may be varied by agreement of the parties.
6The Board remains seized.
