Decision
1The parties met September 24, 2025 to attempt to mediate a settlement of this grievance. At this session the parties agreed to the following continuation dates and case management schedule.
April 8, 24, 30, and May 7, 2026 are set as continuation dates.
The parties agreed to the following timetable for the exchange of documents and particulars:
November 25, 2025 - The Employer will provide the documents on which they rely and the documents sought in AMAPCEO’s letter dated September 22, 2025, including but not limited to the WDHP files requested. The Employer may object to producing any of the documentation sought by AMAPCEO. With respect to any such documents, the Employer will provide the basis for the employer’s refusal to produce it.
January 22, 2026 - The Employer will provide further documents on which they rely and the documents sought in AMAPCEO’s letter dated September 22, 2025. The Employer may object to producing any of the documentation sought by AMAPCEO. With respect to any such documents, the Employer will provide the basis for the employer’s refusal to produce it.
The Employer will indicate which facts described in AMAPCEO's September 22, 2025 letter are in dispute and provide its version of the facts.
The Employer will advise of its intention to raise preliminary arguments, if any.
February 27, 2026 - AMAPCEO will respond to the Employer, including identifying any outstanding production.
1 week before the hearing commences - The parties will exchange book of documents and provide a copy to the arbitrator.
2In the event that any issues arise, such as issues regarding relevance or proof of documents, a conference call can be scheduled.
