September 24, 2025
Decision
1On September 24, 2025 the Parties met and attempted to mediate a settlement of this grievance but were unsuccessful.
2Continuation dates have been scheduled for August 24 and December 7, 2026.
3After hearing the representations from each Party, I have decided to issue a timeline with respect to next steps in this matter, in order to ensure the effective and efficient hearing of this grievance, which has been scheduled under Article 22.16.
4The Union shall provide fulsome particulars and production to the Employer, including any financial documentation the Grievor intends to rely on in support of her alleged losses by no later than December 19, 2025. By December 19, 2025, the Union shall also request production from the Employer.
5The Employer shall respond to the Union’s particulars and request for production by no later than February 20, 2026. This will include notice of any and all preliminary objections it intends to raise on the next hearing date.
6The Employer has specifically advised it has reserved the right to move for dismissal of the grievance in the event the Union does not comply with the Board order.
7Should the Employer choose to bring a motion seeking dismissal, the Union must identify and provide relevant particulars of any reasons it will rely upon to explain its non-compliance with the Board’s direction in advance of the hearing.
