Decision

1This matter is a grievance filed by OPSEU on behalf of several individuals including Pasquale Perrotta and Paul Robertson that was scheduled to be heard commencing at 10:00 a.m. over video conferencing on August 29, 2025. Messrs. Perrotta and Robertson were aware of the time and date of the scheduled hearing. At 10:00 a.m. on August 29, 2025, Messrs. Perrotta and Robertson were not in attendance, nor did they sign in at any time prior to the hearing adjourning for the day hours later. The Grievance Settlement Board is unaware of any reason why Messrs. Perrotta and Robertson did not attend the hearing.

2Messrs. Perrotta and Robertson are hereby ordered to provide to Union counsel the reason for their absence on August 29, 2025, no later than September 10, 2025. Should Mr. Perrotta not provide an explanation the grievance will be deemed dismissed in so far as it pertains to him. Should Mr. Robertson not provide an explanation the grievance will be deemed dismissed as it pertains to him. In the event either Mr. Perrotta or Mr. Robertson, or both, provide Union counsel with reasons for the absence, such reasons are to be provided to counsel for the LCBO who will then determine, and advise Union counsel and the GSB, no later than September 19, 2025, whether the Employer is satisfied with the reasons provided; challenges the sufficiency of the reasons and requires more information; or is not satisfied with the reasons and seeks to have the matter dismissed as against Mr. Perrott and/or Mr. Robertson.

3This matter is scheduled to continue October 29, 2025. Any issues arising out of the foregoing can be dealt with at that time.
