Decision
1Mr. Jason Campbell, a Maintenance Mechanic with the LCBO, filed a grievance on December 15, 2021, alleging that the employer violated his rights under Article 27.4 of the collective agreement and the Attendance Management Programme. He seeks to be removed from the programme and to be made whole.
2The employer submitted that there has been no breach of the collective agreement, or the programme and urged me to dismiss the grievance.
3The parties agreed that I had the jurisdiction to deal with this matter in accordance with the Memorandum of Agreement, on the expedited mediation/arbitration process found in Appendix 2 to the collective agreement. They asked that I issue a decision without precedential value, and without written reasons.
4Having carefully considered the submissions of the parties on the grievance, I find that there has been no breach of the collective agreement or the Attendance Management Programme, and consequently must dismiss the grievance.
