Decision

1The Complaint before me raises a number of issues.

2The Parties agreed to remit the issue of whether the Complainant should have been converted into the Youth Justice Trainer position effective July 31, 2022, to me for expedited determination, without reasons.

3Having regard to the materials before me and the representations of the parties, I direct the Employer to place the Complainant into the position of Youth Justice Trainer within the Staff Training, Development and Recruitment Unit (STDRU), Ministry of Children, Community and Social Services on a permanent basis retroactive to July 31, 2022, with all commensurate compensation and benefits. The Complainant is deemed to have completed her probationary period. The Employer is to make any necessary changes to the Complainant’s WIN and current temporary assignment agreement to reflect this change.
