SUBMISSIONS

Decision

1This is a motion for Dismissal of the subject Grievance.

2The Grievance Settlement Board released a Decision in this matter on January 11, 2024. There, the Grievor, David Aris, was directed to provide Counsel for the Union with the reason for his non-attendance at the hearing held on January 11, 2024.

3That Order was to be complied with by no later than February 2, 2024, failing which “his grievance will be dismissed”.

4Counsel, Anjana Kashyap, confirmed on behalf of the Union that the Grievor had been duly provided with a copy of the January 11^th^ Decision in a timely manner.

5Further, she advised that neither she nor the Union had received any response whatsoever from the Grievor up to February 6, 2024, the date of preparation of this Decision.

6Mr. Mackenzie Anderson, Counsel for the Employer, confirmed the same on behalf of his client. In the circumstances, he moved that the matter be dismissed.

7Although Ms. Kashyap requested an extension on behalf of the Grievor, there was no legal basis for that request that had not been raised prior to release of the original Decision of January 11^th^.

8In the circumstances, I hereby dismiss the Grievance of Mr. David Aris which is referenced as GSB #2022-11967 and the Union #2023-0499-0005.
