October 31, 2024
Decision
1At the hearing convened on October 31, 2024, with the arbitrator’s assistance, the parties discussed various case management issues in preparation for litigation, presently scheduled to resume on January 13, 2025. During these discussions they agreed on terms and timelines with respect to particulars and production and requested that those be issued as a Board order. Having regard to their agreement and request, the Board orders as follows:
The Union is directed to provide to the Employer no later than November 2, 2024, its written revised particulars with respect to each alleged act or omission by the Employer.
No later than November 12, 2024, the Union shall provide to the Employer in writing a list of remedies it intends to seek at the hearing.
The Union is directed to disclose to the Employer no later than November 15, 2024, any and all documents it intends to rely on at the Hearing.
The Union is directed to disclose to the Employer, with appropriate redactions, all medical documents including the grievor’s medical file, no later than November 22, 2024.
The Employer is directed to provide in writing to the Union notice of any preliminary motions/objections it intends to raise, no later than November 30, 2024. The Employer reserves the right to raise such preliminary issues.
The Employer is directed to provide its disclosure to the Union no later than November 30, 2024.
Any of the terms or timelines in this order may be amended by the parties on agreement or by further order by the Board.
