October 18, 2024
Decision
1At the hearing convened on October 18, 2024, with the arbitrator’s assistance, the parties discussed various case management issues in preparation for litigation. During these discussions they agreed on timelines for the submission of particulars and production and requested that the agreed upon terms be issued as a Board order. Having regard to their agreement and request, the Board orders as follows:
The Employer is directed to provide by December 2, 2024, its disclosure (if any is outstanding) regarding the termination of the grievor’s employment.
The Union and the grievor are directed to provide by December 16, 2024, full written particulars (what was done or not done, when, where, by what means and by whom) with respect to each alleged act or omission by the Employer, and its disclosure in respect of the 5 grievances.
Employer is directed to advise the Union of any preliminary motions/objections by February 28, 2025. If there are none, the Employer is directed to provide its disclosure to the Union by February 28, 2025.
Any of the terms in this order may be amended by the parties on agreement or through a teleconference with the Arbitrator.
