Decision

Production Order

1This is a termination case. The Grievor was a correctional officer. His employment was terminated in September 2022.

2There have been two hearing dates: January 9, 2023 and June 21, 2023. The parties spent the majority of those dates attempting to mediate the grievance. Unfortunately those efforts were unsuccessful and the parties turned their attention to issues of particulars and production. There has been some production of documents but some documents have not yet been produced. Particulars have also not been provided to date.

3The next hearing date is scheduled for April 18, 2024. The parties have advised, barring an unforeseen development, they intend to begin the case that day.

4As part of the parties’ efforts to ensure they are ready to begin the case on the next hearing date, the parties requested an order from the Board. Accordingly, I am making the following order:

ORDER

(i) The Union will provide the Employer with particulars by no later than January 15, 2024.

(ii) Any outstanding production will be exchanged by no later than January 30, 2024.
