HEARING

Decision

1Having heard the submissions of the parties, I make the following Order:

1. By November 15th, 2022, the Union shall produce to the Employer any and all medical documentation it intends to rely on in the hearing of these grievances;

2. By December 15th, 2022, the Union shall provide an amended statement of particulars, if any, to the Employer;

3. Upon receipt of all of the above documentation, the parties will consult on further litigation steps and contact the Board with respect to any scheduling needs;

4. Should the Union fail to meet any of the above deadlines, the Employer will be permitted to schedule a hearing date to proceed with its original preliminary motions (scheduled for September 15, 2022), and the Union will not be entitled, barring extraordinary circumstances, to provide further medical documentation or amended particulars prior to the hearing of the Employer’s motions or at any subsequent hearing on the merits.
