Decision
1A hearing was scheduled in this matter on September 23, 2022. The grievor failed to attend the hearing. Counsel for the Union understood that this may be because of a family medical emergency.
2This Consent Order addresses the next steps in this matter.
3The Employer consented to an adjournment of the hearing so long as the grievor provided a suitable explanation for her inability to attend. The grievor is therefore ordered to provide a written explanation for her non-attendance within two weeks of the date of this Order. In the event that an emergency medical situation is ongoing past the two-week time frame, the Union may request an extension of this timeline on the grievor’s behalf.
4The grievor is cautioned that if she fails to explain her absence as required by this order, or if she fails to attend any future hearing dates, the parties may be invited to provide submissions as to whether or not the grievance should be dismissed.
5Further, to ensure that any subsequent days of hearing proceed expeditiously, the Union is ordered to provide full particulars as to the substance and nature of the grievance and the allegations against the Ministry no later than 60 days prior to the next scheduled hearing day.
Dated at Toronto, Ontario this 26th day of September, 2022.
