Decision
1The instant order results from an agreement arrived at by the parties on May 9, 2022.
2In my decision dated April 20, 2022, I directed the Union to provide particulars and documents by May 3, 2022. However, for various reasons, the Union was unable to meet this deadline.
3Accordingly, I order, on consent of both parties, that the Union provide the particulars and documentation listed in the April 20, 2022 decision to the Employer by June 17, 2022. The Employer will then have until August 26, 2022 to provide the Union with submissions regarding preliminary issues it may have as a result of the particulars and documents referred to herein, in addition to the revised particulars of the Union dated March 21, 2022, and the documents attached.
4The Union will not be able to raise any new issues or provide further particulars beyond this date, unless specifically requested by the Employer or unless they flow directly from any further disclosure the Employer either agrees to provide or is ordered to produce in response to the Union’s letter dated March 10, 2022, with respect to documents not captured in the April 20, 2022 decision.
Dated at Toronto, Ontario this 16th day of June, 2022.
