January 5, 2022 Videoconference Call

Decision

[1]. This policy grievance was filed by the Union in respect to the Employer’s Mandatory Vaccination/Vaccination Disclosure Announcements. The parties appeared before me in a Conference Call to set out a litigation schedule.

[2]. The Employer is raising a preliminary issue with respect to the timeliness of the referral to arbitration. The parties agreed that the preliminary issue will be argued by way of a Statement of Facts (“SOF”). The Employer agreed to deliver a draft SOF to the Union by January 6, 2022. The preliminary issue will be argued in a video hearing on January 17, 2022 at 8:30 a.m.

[3]. There is an outstanding request for production of documents made by the Union in a letter dated December 22, 2021. The Employer is to provide its response, including any undisputed documents, by January 19, 2022.

[4]. The Union is seeking particulars from the Employer and is to provide a detailed request by January 7, 2022. The Employer is to provide its particulars in response to the request by January 31, 2022. The Union is to provide its response particulars by February 11, 2022. Additionally, the Union is to set out its position in detail with respect to the order of proceedings.

[5]. I will hold a conference call on February 24, 2022 at 8:30 a.m. to determine the next steps in this matter. Should the parties require my assistance prior to this date, they should write to the Registrar seeking to schedule a conference call on an expedited basis.

[6]. I remain seized.
