Decision
1At the hearing on November 22, 2022, the parties agreed to make best efforts to provide disclosure and particulars to one another by February 28, 2023 as follows:
Union to provide:
Metrolinx Health & Wellness department file – with grievor’s consent for disclosure to Union and Employer counsel.
All clinical notes and records of any doctor, specialist or other health professional who has treated, assessed or been seen by the grievor in respect of the medical conditions at issue.
Prescription records from August 2020 to present.
EI and/or CPP file for any statutory disability benefits claimed.
Particulars of accommodations and/or positions not provided by Metrolinx.
Employer to provide:
- Documents related to consideration of accommodations and efforts made to accommodate the grievor’s medical conditions.
