Decision
1This matter was scheduled for a hearing on June 8, 2021 at 10 am by Videoconference. By 10:20 am all parties other than the Grievor were present. I am advised by OPSEU counsel that she had previously spoken to the Grievor about the date and had provided her with the Videoconference link. Moreover, OPSEU counsel also phoned her twice on the morning of the hearing but received no response.
2OPSEU asks for an adjournment on terms.
3I hereby make the following order:
The Grievor is to provide to the GSB, no later than June 22,2021, a written explanation as to both why she did not attend this hearing and why she did not advise OPSEU ahead of time of her intention not to attend.
If I am satisfied with the Grievor’s explanation, then a new hearing date will be sent.
If I am not satisfied with the Grievor’s explanation or if no explanation is submitted, then upon an application by the LCBO, the grievance will be dismissed.
OPSEU is to bring this order to the attention of the Grievor immediately by both email and by regular mail.
Dated at Toronto, Ontario this 8th day of June 2021.
