Decision
1The parties entered into Minutes of Settlement, dated January 13, 2021, which the Union alleges were breached by the Employer.
2Having heard the submissions of the parties, I make the following Order:
The T4 to be issued by the Employer to the Grievor for 2021 will not include the amount of $8341 that it paid for 2019 vacation credits, if the Grievor fully repays this amount by July 1, 2021.
For clarity, to repay these funds, the Grievor must send a cheque by July 1, 2021, payable to the Minister of Finance, to the following address:

- The Employer will pay the Grievor for his accumulated vacation credits for 2019, 2020 and 2021, at the appropriate rate of pay, between January 1 and March 31, 2022. For greater certainty, the Grievor’s vacation entitlement equals 81.78 credits.
4The parties have agreed that I will retain jurisdiction in the event that an issue arises with respect to the implementation or interpretation of this Order or the terms of the Minutes of Settlement.
