INTERIM DECISION

1The Board convened a conference call with Counsel on February 8, 2021 and heard representations from the parties regarding the factual and legal background to this grievance.

2Having heard the representations of counsel, and on the consent of the parties, I hereby direct the Centre for Addiction and Mental Health and/or its C.E.O. Ms. Catherine Zahn to provide all documents, notes, records, correspondence, etc related to Michael Kay to Union Counsel, Dean Ardron of Ursel Phillips Fellows Hopkinson LLP, at their earliest convenience.

3Upon receipt of the materials, the Union will produce all arguably relevant documents contained in the materials to Metrolinx without delay. Should the Union redact any materials, it will advise Metrolinx of the nature of the redactions.
