DECISION
1Mr. Mike Cranley, a Correctional Officer at the Quinte Detention Centre, filed a grievance on November 16, 2018, alleging that the employer breached the collective agreement by wrongly disciplining him with a seven-day suspension. He seeks full redress and to have any record of the suspension removed from his file. The employer submitted that there was just cause for the discipline and no violation of the collective agreement.
2The parties referred this grievance to mediation/arbitration in accordance with Article 22.16 of the collective agreement. At the outset of the hearing, the parties agreed that I had the jurisdiction to deal with this matter. They asked that I issue a decision without precedent or prejudice, and without written reasons.
3Having carefully considered the submissions of the parties, as well as the jurisprudence of the Board, I have decided to deny the grievance and it is hereby dismissed.
Dated at Toronto, Ontario this 13th day of March, 2020.
