Decision
1The parties have consented to the following order.
2The Union will provide further and better particulars to the Employer of the facts on which it and the grievor rely with respect to her grievance of August 15, 2018. These written particulars are to include not merely legal conclusions but, in addition, the facts which the union and the grievor assert support any such conclusions and demonstrate the breach of the collective agreement alleged. With respect to each act or omission alleged, the particulars shall indicate what was done or not done, when, where, by what means and by whom and, to the extent motivation may be a relevant factor, with what motivation.
3The particulars will be treated as confidential and disclosed only to the extent necessary to enable the Employer to make necessary inquiries for the purposes of these proceedings.
4These particulars are to be provided no later than February 1, 2021.
5This order is without prejudice to any other preliminary matter that the Employer may raise.
