DECISION
1On August 8, 2019, a hearing by teleconference was held to determine the process with regard to outstanding issues in the instant group grievance.
2Having regard to the respective positions of the parties, it is ordered as follows:
(a) In the event that the grievance as it relates to employees in “category A” is still outstanding, the employer shall no later than September 06, 2019, provide to the union its position on the claims made by the union on behalf of those employees together with preliminary particulars it will be relying on to support that position.
(b) If the employer is raising an estoppel argument, it shall provide to the union no later than September 11, 2019, particulars with respect to the assertion of estoppel, and also identify the first witnesses to be called on September 27, 2019, in relation to estoppel.
3The Board remains seized and the hearing will continue as scheduled on September 27, 2019.
