Decision

1A Conference Call was conducted on May 1, 2019 between this Arbitrator and the representatives of the parties.

2On the consent of the parties, it is ordered that the Investigation Report of Mr. Dorian Persaud dated November 9, 2017 be disclosed by the Employer, subject to the following terms and conditions:

1. The document and all copies thereof are to be maintained in Union Counsel’s possession.

2. The document is to be reviewed by the Grievor and one union representative of her choosing only in the presence of Union Counsel.

3. The Grievor and her chosen union representative are not to discuss the contents of the document with anyone else except Union counsel nor are they to discuss the document between themselves in the presence of others.

4. Soft/electronic copies of the document are not to be made.

5. The document is for the purposes of this litigation and for no other purpose.

6. The document is to be destroyed at the conclusion of the litigation except to the extent Union Counsel may be required to maintain a copy in her file pursuant to her professional obligations.
