Decision

1The union requested that the Board order the employer to make a quarterly payment due on April 28, 2019, pursuant Minutes of Settlement (MOS) agreed to by the parties on January 15, 2015, on or before April 29, 2019. The employer gave its assurance at the hearing that the payment would be made on or before April 29, 2019, and therefore there was no need for an order from the Board. The union submitted that given the employer was late in making three payments in 2018, as required under the MOS, and has acknowledged such, the order is necessary.

2The MOS keeps me seized of any dispute concerning the quarterly payments required under the agreement and thus, I have the jurisdiction to make this kind of order. Consequently, having considered the full submissions of the parties, and given the circumstances, I hereby order that the employer must make the payment, due April 28, 2019, pursuant to the MOS, on or before April 29, 2019.
