March 25, 2019
Interim Decision
1The parties met and addressed a variety of case management issues at the hearing scheduled for March 25, 2019.
2Further to that discussion, the following is ordered:
a. Mr. MacDonald is to keep the Board apprised of the status of his criminal trial, including all scheduled dates, any court/bail orders that are in effect, and any court decisions. Any change in status should be reported to the Board within 15 days of the change.
b. All parties are to advise the Board, by April 12, 2019, as to their position with respect to the issue of adjourning this matter pending completion of Mr. MacDonald’s criminal trial.
c. The Employer and Mr. MacDonald are to advise the Board, by April 12, 2019, as to their position with respect to the Cody et al grievors’ request for accommodation, including whether there is any dispute as to whether a basis for accommodation has been substantiated.
d. The Employer is to produce to the Cody et al grievors’ the documents as specified in Mr. Bryden’s letter of January 17, 2019, with clarifications as discussed during the hearing.
