DECISION
1The subject grievances relate to scenarios at the Central Ambulance Communication Centre (CACC) in Oshawa.
2The Grievors’ duties as Ambulance Communication Officers (ACO-1) are largely comprised of the processing of requests for Emergency Medical Services (EMS/Paramedics) and the dispatch of EMS resources.
3There has yet to be a proper crystallization of issues in this matter.
4Therefore I hereby Order that the following representative Grievors, Steve Shortt, Ruth Staniszewski, and Jacqueline Lewis Wood, signify to the Union by December 4th 2019 whether or not they will continue to participate in the process, including but not limited to reviewing production, providing detailed particulars and participating in the hearing process.
5If their commitment is confirmed then the Union will, for those Grievors, identify the shifts and dates for which the Union still requires production on or before February 28, 2020. Should the Union require additional time to identify the required production a further request can be made to the Board.
6For those Grievors who decline the commitment in paragraph 4, the Union will identify different Grievors as new representative Grievors and provide a list of shifts for which these Grievors are requesting production. The identification of new Grievors is without prejudice to any preliminary motions the Employer may bring with respect to the use or identity of new representative Grievors.
7The Union will advise the Employer of the identity of any new representative Grievors going forward on or before January 17, 2020. The new Grievors will undertake to participate in the process going forward including but not limited to reviewing the required documentation, providing particulars, and attending at the hearing as necessary.
8Having identified those new representative Grievors, the Union will provide a request for production on or before February 28, 2020. Should the Union require additional time to identify the required production a further request can be made to the Board.
9The Grievors identified in paragraph 4 who decline to participate as outlined in this decision will have all of their grievances in relation to this issue dismissed, which includes any right to remedies from those Grievances that continue on.
10The parties agree to make best efforts to set a date in March of 2020 in order to discuss the state of production, particulars and any preliminary motions the parties may have.
