Decision

1This matter has a long history. The parties signed Minutes of Settlement on October 14, 2014. Pursuant to the Minutes of Settlement the parties agreed to keep certain terms confidential. The parties also agreed that the settlement was entered into without any admission of liability by any party.

2The parties agree that abiding by settlement obligations has an important labour relations purpose.

3The Union concedes that it breached the Minutes of Settlement by publishing in their 2018 Convention Update that the grievor “won” his complaint that was settled under the 2014 minutes of settlement.

4The Union has made it clear that it takes settlement obligations (including confidentiality and no admission of liability agreements) very seriously and is committed to upholding such obligations in the future.

5In the event that there are any issues with regard to the interpretation of this decision I shall remain seized.
