Interim Decision

1A termination grievance dated March 12, 2018 filed by Mr. Benjamin Kalikoff (“Grievor”) came before the Board on July 27, 2018. Settlement discussions between the parties failed. The arbitrator and counsel fixed multiple days for arbitration and discussed process issues. As a result of these discussions, the Board hereby orders as follows:

ORDER

(1) The Board hereby orders the grievor, Benjamin Kalikoff to produce his cellular telephone records for March 17, 2017, including but not limited to:

• Telephone calls sent and received;

• E-mails sent and received;

• Text messages sent and received; and

• Internet history logs

2If he is unable to obtain the information through his own efforts, the grievor is ordered to obtain that information from his telephone cellular service provider.

3Upon obtaining the information, the grievor is ordered to forthwith provide that information to counsel for the union.

4The Board remains seized and the hearing shall continue on the dates scheduled.
