Decision
1I have a number of discipline grievances before me filed on behalf of Mr. J. Pacheco. During the course of the hearing on July 6, 2017, I entertained submissions from counsel on how the disclosure of an audio recording made by Mr. Pacheco during a meeting on February 12, 2016, should be handled. Having regard to the circumstances, I directed the Union to produce the relevant audio recording to Employer counsel forthwith. Employer counsel shall be permitted to share the audio recording with Ann Fowler, Tom Dykstra and Joy Gordon Adams for the purpose of seeking instructions. Employer counsel and the named Employer representatives are directed not to disclose the audio recording or its contents to anyone except with the consent of the Union or an order from the GSB.
