Decision
1This matter is a grievance filed by Ontario Public Service Employees Union (the “Union”) on behalf of Avril Louis.
2Further to representations made by the parties during the course of a mediation session held on June 28, 2017, I understand Ms. Louis has a medical appointment scheduled for August 22, 2017. The Union is hereby directed to write to the doctor in question and ask that the doctor assess and provide his/her opinion as to Ms. Louis’s fitness to return to work; to participate in the process provided for in the Workplace Discrimination and Harassment Policy; and to participate in the arbitration process before the Grievance Settlement Board.
3The Union is further directed to provide to the Employer, within 90 days of Ms. Louis obtaining a medical note stating that she is able to participate in the arbitration process before the Grievance Settlement Board, particulars alleged by Ms. Louis in support of her grievance.
4Once particulars have been provided by the Union to the Employer, the parties are directed to contact the Grievance Settlement Board with a view to setting hearing dates.
