Decision

1A mediation in this matter was held on September 13, 2016. At this time the parties were unable to reach a settlement. Subsequent to the mediation, continuation dates were set for April 12, 2017; May 16, 2017; and September 11 & 19, 2017.

2There are four grievors in this case, Rick Kennett, Grant Manske, Kristy Galloway and Christopher Chown.

3At the hearing on April 12, 2017 the employer brought a motion to dismiss this matter which the union opposed.

4Based on the submissions of the parties and the evidence before me I hereby declare and direct as follows:

1. The employer is directed to pay to counsel for the union in trust the sum of $500;
2. All issues raised in the grievance are dismissed.

5The additional hearing dates are hereby cancelled.
