Decision

1The Employer and the Union at the Maplehurst Correctional Centre agreed to participate in the Expedited Mediation-Arbitration process in accordance with the negotiated Protocol. A number of the grievances were settled through that process. However, this grievance remained unresolved requiring a decision from this Board. The Protocol provides that decisions will be issued within a relatively short period of time after the actual mediation sessions and will be without reasons. Further, the decision is to be without prejudice and precedent.

2Approximately one hundred and seventy grievances were filed by various Correctional Officers alleging that the Minister of Community Safety and Correctional Service (at the time) “poisoned’ the work and home environment of the grievors as well as their “standing” in the community. By way of remedy the grievors wanted a public apology and retraction by the Minister; the resignation of the Minister; and $10,000 per CO for the “public humiliation”.

3Simply put, there is no violation of the Collective Agreement. Further, I note that there was no evidence of a poisoned work environment, poisoned home environment or poisoned community environment provided. I do not doubt that there were COs who were of the view that the comments made by the Minister were ill advised, but that does not bring about a finding of a violation of the Collective Agreement.

4Accordingly, the grievances are denied.
