Decision

1At the conclusion of the evidence in this case the parties requested the opportunity to submit their final arguments in writing only, which was acceptable to the Board.

2Thus following consultation with the parties, the Board has agreed to receive written argument on the grievances in this matter according to the following timetable:

1. The Union will deliver its submissions by 5:00 p.m. on Monday, July 11, 2016;

2. The Employer will deliver its submissions by 5:00 p.m. on Monday,

August 8, 2016;

3. The Union will deliver any reply submissions by 5:00 p.m. on Tuesday, August 23, 2016; and

4. The Vice Chair may confer with the parties through their counsel by email communication on or by 5:00 p.m. on Wednesday,

August 31, 2016.

3The following further instructions are provided with respect to the submission of the representations:

(a) The representations will be sent in paper form to the Registrar on the dates stipulated or earlier than the deadline date at the applicable party’s option;

(b) At the same time that the written representations are delivered to the Registrar, the party will deliver an electronic version directly to the Vice Chair; and

(c) If there any disputes between the parties respecting the appropriateness of the submissions, they shall schedule a telephone conference with the Vice Chair through the Registrar’s officer to deal with the dispute by at least 5:00 p.m. August 31, 2016.
