HEARING
January 29, 2015
1Six Finance and Personnel Clerks at the Toronto South Detention Centre, filed grievances between July31, 2014 and August 15, 2014 alleging as follows: “the position of Assistant Business Administrator temporary assignment has been given to someone outside of Local 5112 for longer than six months and no temporary assignment opportunities have been offered to any Local 5112 administrative staff”. They seek full redress, including temporary assignment opportunities and damages. The parties agreed to hear the matter as a group grievance. The employer submitted that there was no violation of the collective agreement.
2The parties referred this grievance to mediation/arbitration in accordance with Article 22.16 of the collective agreement. At the outset of the hearing, the parties agreed that I had the jurisdiction to deal with this matter. They asked that I issue a decision without precedent or prejudice, and without written reasons.
3Having carefully considered the submissions of the parties, as well as the jurisprudence of the Board, I hereby deny these grievances.
