Decision
1The grievances before me in this case relate to the termination of five employees at the Elgin Middlesex Detention Centre. On the first day of the hearing two procedural issues were raised with respect to disclosure and the consolidation of related grievances. I provided the parties with oral rulings on both issues, and this decision confirms those oral rulings.
2First, I hereby confirm that two grievances involving lesser discipline but related to the same factual circumstances should be consolidated with the grievances already before me. Those two grievances are the grievances of Tanya Zavitz, 2014-2637 and Chris Smith
2014-2638.
3Second, with respect to disclosure of documents, such disclosure is subject to the following conditions:
Any material disclosed is only to be used for the purposes of this litigation, and for no other purpose.
Any information disclosed is not to be shown, provided or disseminated to anyone else other than those necessary for the purposes of this litigation, except upon further order of the Vice-Chair.
At the conclusion of this litigation, all documents and copies, and other material disclosed will be returned by the grievors, except that union counsel will retain counsel’s litigation file, which is protected by the standards established by the Law Society of Upper Canada.
4The hearing will continue on a date to be arranged with the parties.
