HEARING
August 16, 2013
Decision
1I have before me a number of grievances filed by three Conservation Officers who are canine handlers alleging a failure on the part of the Employer to properly exercise its discretion when it denied certain meal allowance claims. The parties engaged in a med/arb process at the hearing on August 16, 2013.
2After hearing from the representatives of the parties, I am satisfied that these grievances and this proceeding should be resolved by my issuing the following declaration:
The Employer understands that the Grievors believed that their claims for overages on meals were not being reviewed fairly pursuant to the travel directive and this has led to the filing of these grievances.
The Employer regrets this and states that it did not intend to deny the Grievors the ability to claim overages under this policy.
The Employer will reasonably apply the travel directive in the spirit as intended in accordance with its purpose.
3This proceeding is hereby terminated.
Dated at Toronto, Ontario this 11th day of September 2013.
