Decision
1The parties appeared before me on April 13, 2012, for a mediation-arbitration of the termination grievance of Mr. Chris Gubert. Mr. Gubert’s employment was terminated by the Ministry on December 9, 2011. On agreement of the parties, this matter was addressed pursuant to Article 22.16 of the Collective Agreement. Having heard the representations of the parties and upon reviewing certain documentation relevant to the discipline, I hereby direct that Mr. Gubert be reinstated to employment effective April 16, 2012, in accordance with terms to be negotiated by the parties. I will remain seized of this grievance. In keeping with the principles of Article 22.16, this direction will be without precedent and prejudice.
