HEARING

Decision
1This Union policy grievance is scheduled to be heard on Friday, August 12, and on Tuesday, November 1, 2011. The Union has recently provided the Employer with particulars. The Employer takes the position that the Union has not provided sufficient particulars in the circumstances. The Employer therefore requests that the hearing scheduled for August 12, 2011, be adjourned. The Union opposes this request. A conference call was held on Monday, August 8, 2011, to deal with the Employer’s adjournment request.
2After entertaining submissions from counsel, I determined that it was appropriate in the circumstances to adjourn the hearing scheduled for August 12, 2011. The first day of hearing will now take place on Friday, September 16, 2011. Further to the discussions between counsel about how this matter will be heard, the purpose of the hearing will be to determine if the Union can make out a prima facie case for its policy grievance.
