Decision
1The grievor was discharged on July 8, 2011.
2In the interests of expedition and notwithstanding the fact that discharge grievances are not typically dealt with in this fashion, the parties agreed to put the matter before me in accordance with the mediation/arbitration provisions found in Article 22.16 of the Collective Agreement.
3Also in the interest of expedition the parties agreed to ask me to issue a “bottom-line” decision without reasons. Of course, in accordance with Article 22.16 of the Collective Agreement, apart from resolving the instant grievance, this decision will be entirely without precedential value.
4Having regard to the submissions of the parties and the materials before me I hereby direct and order the following:
a) The grievor is to be reinstated as a Parole and Probation Officer 2 as of August 22, 2011.
b) The discharge effective July 8, 2011 will be substituted with a twenty (20) day suspension.
c) The grievor will not receive any retroactive compensation.
