Decision
1This is a further decision in the line of decisions stipulating requirements for systemic change in the Toronto Jail in order to achieve the organizational targets the parties have set themselves, or that have been set for them. It is aimed at addressing issues that have arisen in the investigation of the hate crimes at the Toronto Jail.
2The Union raised concerns about the thoroughness of the investigation and the pace at which it is proceeding. In particular the Union raised concerns about the nature of the investigation which was occurring with respect to a letter discovered in April 2010 and the need for an active and aggressive investigation in light of the letter received by some individuals in late November 2010.
3Having discussed the issues with the parties and having heard their positions, I issued the following orders.
4As soon it has the information, and by no later than January 31, 2011, the Employer will advise the Union and the Board of the handwriting expert it has engaged to assist in the handwriting investigation currently underway.
5If the Union has any issues with this appointment it may raise them at the scheduled hearing on February 1, 2011.
6By December 17, 2010, the Employer will advise the Union and the Board of its recommendation for who should conduct the review of the investigations to date into the hate crimes. In making its recommendation the Employer will provide details of the candidate’s background and of why the Employer considers the individual to be qualified.
7By January 21, 2011, the Union will advise the Employer and the Board whether it accepts the proposed candidate. If not, it will offer an alternative or alternative or the alternatives for the Employer to consider, providing details of the candidate’s background and of why the Union considers the individual to be qualified.
8The Employer will respond by January 31, 2011.
9Any issues not resolved will be addressed at the hearing scheduled for February 1, 2011.
