Decision

1The parties each seek the production of certain documents from each other. Neither side objects to the other’s request. Indeed, the documents in question have already been produced in the context of another proceeding before this Board (GSB File No. 2008-0897). That production, however, was subject to the implied undertaking that the documents produced be used only for the purposes of that case. That is why the parties seek a fresh order.

2The parties are hereby directed to produce the documents in question. Effectively, this means that they may now consider the prior production to have (also) been made for the purposes of the instant case and that the documents already produced may now properly be used for those purposes.
