HEARING CONFERENCE CALL

Decision

1On July 14^th 2009, I assisted the parties in reaching an Interim Memorandum of Agreement regarding the three grievances filed by Ms. Kutsenko.

2Two conference calls were held on January 26, 2010 and March 26, 2010 to discuss an assertion from the grievor that there has been a breach of the Memorandum of Agreement.

3At a hearing held on April 21, 2010 the parties were given further opportunity to comment on the matter.

4At the hearing I gave an oral ruling with reasons. The parties asked that I provide my decision in writing. I am of the view that the Memorandum of Agreement has not been breached for the reasons provided at the hearing.

5The parties agreed that the three grievances are consolidated. The Union will send the two grievances that were held in abeyance to the Board forthwith for consolidation.

6By agreement of the parties I remain seized.
