HEARING FINAL SUBMISSIONS
October 20, 2009. November 9, 2009.
Decision
1Ms. Andrea Lewis, a probation and parole officer, with the Ministry grieved on December 24, 2007, alleging that the employer breached the collective agreement. The employer denied that it had violated the collective agreement.
2The parties referred these grievances to mediation/arbitration in accordance with Article 22.16 of the collective agreement. At the outset of the hearing the parties agreed that I had the jurisdiction to deal with this matter. The parties asked that I issue a decision without precedent or prejudice, and without written reasons in accord with the practice for expedited hearings under Article 22.16.
3Having carefully considered both the oral and written submissions of the parties, as well as the jurisprudence of the Board, I hereby deny this grievance.
Dated at Toronto this 3rd day of March 2010.
