Decision

1Further to the order of the Board in the decision dated January 11, 2010 and the parties’ submissions regarding the necessary production in these proceedings, I hereby order as follows:

a) the Parties will attempt to identify from training materials and other documents anonymized examples of the relevant documents identified by the Parties in the Agreed Statement;

b) if the Parties are unable to identify examples as outlined in paragraph (a), the Employer will identify and disclose copies of examples of relevant documents from the client files maintained by the Employer, including screen shots of information from the applicable databases maintained in relation to those files;

c) All documents disclosed pursuant to paragraph (b) are to be anonymized as much as possible and are to be maintained in a secure fashion in order to prevent any unauthorized disclosure of the documents.
