HEARING
February 29, 2008.
Decision
The grievor, Ms. Jennifer Vanzetten has grieved that the employer contravened the collective agreement, including articles 26 and 31, by forcing her into resignation.
The relevant facts were presented orally on consent at the hearing. The grievor commenced her employment as a casual Customer Service Representative on May 17, 2001. On May 3, 2002 she submitted a letter of resignation. In this grievance the grievor claims that her letter of resignation was not voluntary, and seeks the reinstatement of her original seniority date and compensation for all monies lost.
Having regard to the relevant facts and the submissions of the parties tendered at the hearing, I hereby order that the grievor’s original seniority date be adjusted to reflect the date of May 17, 2001. This order is to be effective the week commencing on March 31, 2008. In the circumstances no order is made for any monetary compensation.
