Decision

On September 5, 2007, the parties reached a comprehensive settlement of this matter in a mediation conducted by me. Paragraph 9 of the Memorandum of Settlement required the grievor to send a certain letter by September 15, 2007. As of November 9, 2007 she has failed to do so, and as such she is in breach of the Memorandum of Settlement.

If the griever does comply with her obligations under paragraph 9 of the Memorandum of Settlement by November 30, 2007, the employer shall pay the grievor the amount set out in paragraph 1 of the Memorandum of Settlement, less a $100.00 deduction because of her failure to comply with the terms of the Memorandum of Settlement.

If she does not fully comply with her obligations under paragraph 9 of the Memorandum of Settlement by November 30, 2007, the employer is relieved of its obligations under paragraph 1 of the Memorandum of Settlement to pay the grievor any monies.
