Decision
The board is seized with a job competition grievance filed by the grievor, Mr. Lawrence Sin, which is scheduled for hearing on April 17, 2007.
By a teleconference call on April 10, 2007 Union counsel sought an order for the production of the contents of the personnel files of all of the incumbents in the position of Product Consultant. Employer Counsel did not oppose the request for production and indicated the employer’s intention to comply with any order issued by the Board.
In the circumstances, the employer is hereby ordered to produce to the union, as soon as reasonably possible in advance of the hearing, the contents of the personnel files of all of the incumbents in the position of Product Consultant, as the files were constituted as of the date of the job competition in question. The union is directed to treat the information produced pursuant to this order with confidentiality, and to use such information only for the purposes related to this proceeding.
